The notary advises his clients on difficult and far-reaching legal transactions such as property purchases, wills or marriage contracts. The duties of a notary include legal counselling and the drafting of contracts and the subsequent recording as well as the entire practical completion of the transaction (applications for registration in the land register and commercial register, etc.).
Apart from recording contracts or other legal transactions, the notary is also responsible for the authentication of signatures and executing certified copies of documents.
The notary is independent of the state and client and has a duty to remain neutral. As impartial intermediary he does not decide disputes between the parties concerned. Like doctors the notary is sworn to secrecy. This also applies to his employees In Hamburg and a few other federal states (for example Bavaria) the notary practises his professional full-time and may not work as a lawyer at the same time.
The notary is a jurist and after special training is appointed by the judicial authority of the federal state concerned.
