Standard notarial charges applicable nationwide are laid down in the Regulations on Ex Parte Costs. Their amount solely depends on the transaction value, which is normally calculated according to the market value (economic value), not according to the possibly lower tax base. For example, if a property is sold at purchase price of 200,000.00 euros, the purchase price will be the transaction value. The notary is prohibited by law from charging higher or lower fees than those stipulated in the Regulations on Ex Parte Costs.
When concluding a contract the parties concerned must agree who is to bear the costs. Should this contracting party not pay, the notary must collect the outstanding fees from the other parties.
To the aforesaid fees must be added expenses of the notary, e.g. copies of documents, telephone calls and postage as well as statutory value-added tax.
